Here’s the Likely Timing for Summary Judgment for the Ripple Lawsuit per Recent Updates
According to recent updates shared by defense lawyer James k. Filan, the key date for motions for summary judgment remains Sept. 13, with opposition to this due by Oct. 18. By Nov. 15, all briefings should be finished, and Judge Torres’ final ruling would be expected.
Filan, on the other hand, says that numerous matters may be decided at different times, making the dates somewhat speculative. However, James K. Filan predicts that Judge Torres’s decisions on expert motion and summary judgment might come on or before March 31, 2023.
According to the defense attorney, the Ripple SEC action is currently awaiting seven decisions. He cites these decisions: the first is a decision by Magistrate Judge Netburn on the SEC’s claim that all of Hinman’s emails were protected by the attorney-client privilege. The second point of contention is Judge Netburn’s DPP decision.
Third, Ripple’s defendants seek to compel the SEC to respond to or amend its responses to certain admission requests (RFA). The fourth concerns the motion for attorney’s costs in connection with Metz’s supplemental report. The fifth is the motion for an amicus brief to participate in the motion to exclude expert testimony “Daubert challenges.” Finally, there are motions to exclude expert testimony and summary judgment.
